Terms and Conditions

1.      THE AGREEMENT

These booking terms and conditions form the contract between you and Tarnda (ABN 34 708 637 749) (“us”, “we”, “our”). By booking an experience with us, you agree to be bound by these terms and conditions.

2.      PAYMENT TERMS

A non-refundable deposit of 30% is required to confirm your booking. Following acceptance of the quote, an invoice will be issued within five (5) business days. Full payment of the deposit must be received a minimum of fourteen (14) days prior to the booking date. If payment is not received, we reserve the right to cancel your booking.

The remaining 70% balance will be invoiced within five (5) business days following the booking and is payable within fourteen (14) days of the invoice date.

Requests to amend payment or deposit terms must be made at the time of booking and are subject to approval at our sole discretion.

3.      CANCELLATION POLICY

A cancellation by you will only be effective upon receipt of written confirmation of cancellation.

If you cancel an experience:

  • More than seven (7) days’ notice: the 30% deposit payment will be retained, and no additional fee will be payable.

  • Less than seven (7) days’ notice: the 30% deposit payment will be retained, and an additional cancellation fee of 20% of the total booking value will be payable.

Custom experiences and event bookings may be subject to alternative cancellation terms, which will be assessed on a case-by-case basis. Any variations will be confirmed in writing or specified in the relevant quote provided at the time of booking.

4.      CANCELLATION BY US

We reserve the right to cancel an experience at any time prior to the experience start time if unforeseen circumstances make it unviable for us to operate the planned itinerary.

In the event of a cancellation by us, you will be offered the option to:

  • Reschedule your booking to an alternative date; or

  • Receive a full refund of any payments already made.

5.      TRANSFERS & CREDITS

We understand that unforeseen circumstances may require you to transfer your booking.

Requests to transfer must be received more than seventy-two (72) hours prior to the experience start time. Requests made within seventy-two (72) hours will be subject to the standard cancellation policy. A request to transfer will only be effective on receipt of written confirmation.

All transfers are:

  • Valid for twelve (12) months from the original booking date; and

  • Subject to availability.

6.      PRICES & SURCHARGES

Our experience prices are subject to variable and seasonal pricing. As such, pricing may change at any time in response to demand, market conditions, and availability.

Any promotional pricing or discounts that may become available after your booking has been confirmed will not apply retrospectively. If you wish to cancel your booking to take advantage of a lower price, the standard cancellation policy will apply. The most up-to-date pricing is available on our website at all times.

All prices are stated in Australian Dollars (AUD). You are responsible for any international transaction fees or currency conversion charges that may be applied by your bank or payment provider.

Additional surcharges may apply at our discretion where relevant to your booking, including but not limited to travel fees or out-of-hours service charges.

7.      VARIATIONS TO BOOKINGS

Any requests to amend or vary your booking, including but not limited to changes in date or time, group size, or custom experience requirements, must be communicated by written confirmation. Requests to vary a booking must be received more than seventy-two (72) hours prior to the experience start time.

All variations are subject to availability and may be declined at our discretion where it is not operationally feasible. Any approved variations may also be subject to additional fees to reflect changes in requirements, which will be confirmed in writing.

8.      CHILD POLICY

Customers under the age of 18 must be accompanied by a responsible adult or caregiver for the duration of the experience. While all reasonable care is taken, the accompanying adult or caregiver is solely responsible for the supervision, safety, behaviour, and conduct of any children in their care.

9.      PARTICIPANT SUITABILITY & REQUIREMENTS

To participate in an experience with us, you must:

  • Be responsible for assessing your own mobility and physical condition in relation to the experience and be confident that you are able to participate safely.

  • Be responsible for assessing your own mental capacity in relation to the experience and be confident that you are able to participate safely.

  • Not be under the influence of drugs or alcohol.

10.  AUTHORITY DURING EXPERIENCES

All experiences are led by a guide. The guide’s decision is final in all matters relating to the safety or wellbeing of any customer or staff member participating in the experience.

If you fail to comply with the instructions of the guide or behave in a manner that compromises the safety or wellbeing of the group, you may be directed to leave the experience immediately, without entitlement to a refund. We may also, at our discretion, refuse future participation in any of our experiences.

You must at all times comply with all applicable laws and regulations of Australia.

11.  CONDUCT & BEHAVIOUR

All participants are expected to behave respectfully towards our guides, staff, other participants, and any communities or environments involved in the experience. Any behaviour that is unsafe, disruptive, abusive, or inappropriate will not be tolerated, including but not limited to racism, discrimination, harassment, or offensive conduct.

We reserve the right to direct you to leave the experience immediately, without entitlement to a refund, if this standard is not met. We may also, at our discretion, refuse future participation in our experiences.

12.  LIABILITY & RISK

To the fullest extent permitted by law, you acknowledge that participation in our experiences involves inherent risks. You accept and assume all risks associated with participation, including those relating to personal injury, illness, or damage to personal property.

We do not accept liability for any loss, damage, injury or accident arising from your participation in an experience, except to the extent caused by our negligence where such liability cannot be excluded under applicable law.

13.  PRIVACY POLICY

Any personal information that we collect about you may be used for purposes associated with the operation and delivery of our experiences. This information may be disclosed to third parties where necessary to facilitate the experience or as required by law.

We will otherwise handle your personal information in accordance with applicable Australian privacy laws.

14.  GOVERNING LAW

These booking terms and conditions are governed by the laws of South Australia, Australia. Any disputes arising in connection with an experience or these terms must be submitted to the exclusive jurisdiction of the courts of South Australia.
